Colombia: Sentencia declara inconstitucional ley de implementación del TLC con EE.UU.

El 18 de marzo recién pasado se publicó la sentencia de la Corte Constitucional de Colombia de 23 de enero de 2013 en el caso C-011 de 2013 (contiene el texto íntegro de la norma) en la que declara en su integridad inexequible por inconstitucionalidad a la ley 1520 de 2012 (conocida como ley Lleras 2), en virtud de acción ejercitada por el Senador Jorge Enrique Robledo. 

La llamada ley Lleras 2 pretendía establecer nuevas propiedades a conceptos del Derecho de Autor (v.gr. derecho de reproducción y de puesta a disposición del público) así como constituir una nuevo organismo jurídico que pondría en marcha medidas tecnológicas para la gestión de esos derechos. 

La proyecto de ley tenía por objeto implementar compromisos adquiridos por virtud del Acuerdo de Promoción Comercial suscrito entre la República de Colombia y los Estados Unidos de América y su Protocolo Modificatorio, en el marco de la política de comercio exterior e integración económica. Para tal fin el Congreso tramitó la iniciativa en las comisiones sexta de Senado y Cámara, encargadas de materias de tratados comerciales. No obstante, al contener disposiciones que trataban directamente temas de derechos de autor (de carácter fundamental) se resolvió que el procedimiento debió someterse al conocimiento de las comisiones primera de Senado y Cámara establecidas para asuntos de derechos fundamentales y conexos a la propiedad intelectual.

No ajustándose al procedimiento la Corte consideró que se presentaba un vicio de procedimiento por falta de competencia, declarándola inexequible (no ejecutable) por inconstitucionalidad.

It is happening!! Brazil grants first green patent

Last week, the Instituto Nacional da Propriedade Industrial (INPI) granted the first Green Patent in the country.

The patent in question is for a process: the treatment of solid waste that claims to reduce environmental impact and does generate electricity. INPI informs that the “invention is based on the technology of pyrolysis, a kind of combustion carried out in the absence of oxygen that reduces the production of toxic gases such as nitrogen oxides and sulphur and carbon monoxide.” Moreover, this technology “produces other gases such as hydrogen and methane, which, due to its high calorific value, can be forwarded to a burner connected to a generator to produce electricity.”

The patent was granted using the program ‘Patent Green’ and thus, it just took nine months after the request! Indeed, one of the purposes of this program was to accelerate the review of applications related to clean technologies – from 5 years to less than 2 years – so...9 month is really speedy!! This program was created by INPI to encourage sustainable development in areas such as: alternative energy, transportation, energy conservation, waste management and agriculture.

INPI informs that at this stage there are 67 patent applications in this new program, and 16 are already pending at the patent examination division.

A good guinea pig?

In January we announced the publication of “The Madrid Protocol in Latin America: Is Colombia changing business strategies or acting as a guinea pig?” [EIPR]. Today’s news relates to this issue, since I read in the Brazilian Instituto Nacional da Propriedade Industrial notice board that Brazil is really preparing for it.

On Monday 4th March the Inter- ministerial Group of Intellectual Property (GIPI) sent to the Chamber of Foreign Trade (CAMEX) the proposed accession to the Treaty. This indeed is showing the interest of Brazil to join the Madrid Protocol, which will facilitate the registration of national trade marks to other member countries – an international registration that eliminates the multiples process/applications.

According to the news published by INPI, if CAMEX agrees, then it will move to the Casa Civil da Presidência da República (Civil House of the Presidency), and later to the National Congress, which will take the final decision.

At present, there are 88 contracting parties. There were not members from Latin America until recently (apart from Cuba). The Madrid Protocol entered in force in Colombia in August 29, 2012 (the 87th member); since then Mexico (the 88th member) followed - entering into force only just: February 19, 2013…urmmm…will Brazil be the 89th?

Brazil: image right is a 'higly personal' right

The Brazilian Superior Tribunal de Justiça (STJ) has given an important decision regarding images right.

The case in question was a photograph of an athlete who authorized the use of his image without financial reward. The athlete in question only granted permission to the Brazilian Olympic Committee for the purpose of the Olympic Summer Festival held in 1995. The company Sports Media was the responsible for the management of such photograph. Later on, Sport Media used the photo by manipulating it via computer graphics and using such final product for the Brazilian Championship Jiu-Jitsu 1995.

At first instance the claim for compensation was denied, a decision that was upheld by the Court of Rio de Janeiro arguing that the use of the photo in the second event was not of detriment to the reputation of the athlete and moreover, that the league to which the image was associated had no commercial purpose.

Last week the STJ overturned such decision and decided against Brazilian Jiu-Jitsu and Sports Media Ventures Ltd. The companies now need to pay compensation for damages due to improper use of image. The court clearly stated that none of the companies have had permission to reproduce the photo and used in such event i.e. jiu-jitsu. However the court clarified that in the case of image rights, the obligation to repair comes from a highly personal right and thus, there is no need for evidence of injury or damage. Moreover, the rapporteur of the case, Minister Villas Boas Cueva, noted that the jurisprudence of the Supreme Court states that “the mere publication of an unauthorized photograph of someone, usually causes discomfort, annoyance or embarrassmenpt, regardless of having been commercial purpose or not.” [Indeed, the integrity right should not be limited to the actual detriment of the person by way of injuring his/her reputation.]

Trade Mark: revocation is operative from the day of declaration – no retroactivity can be sought

Brazilian Superior Court of Justice (STJ) has upheld a decision that determined the National Institute of Industrial Property (INPI) to proceed to the registration of the trade mark Lyon, required by the company 'Calçados Only Ltda.'

Background of the case
Back in 1995 the company named ‘Calçados Only’ applied for the registration of two trade marks containing the words ‘Lyon’, for shoes. INPI denied registration on the grounds that the mark was similar to ‘Piernas Lyon Dor’.
'Calçados Only' appealed to the decision on the grounds that the marks were capable of coexistence - it did not suceed. Moreover, parallel to this, the company brought another action i.e. revocation of the mark for non-use.

These cases were heard by the 5th Federal Court of the Judicial Section of Rio Grande do Sul and later on by the Federal Regional Court of the 4th Region holding that INPI should proceed to registry the mark applied for by 'Calçados Only'.

INPI appealed to the decision on the grounds that company brought the action of revocation four months after the publication of filing their applications for registration and two months after the filing of the suit. There were not effects from such revocation of the earlier mark during the course of judicial proceedings, as this was only recognized after the closure of the administrative processes that denied the request of 'Calçados Only'.
 INPI based its case in the principle of no retroactivity. INPI argued that the subsequent declaration of revocation does not reopen the administrative proceedings or lead to the merits of the lawsuit, which was filed on the grounds that there would be no confusion between the marks. However, INPI affirms that such a declaration ie revocation to the oldest mark, opened the opportunity to submit a new application for registration.

In considering the appeal, the court cited a precedent from the Supreme Court's Second Section (EREsp 964 780), in which it was determined that "the revocation of a trade mark, due to lack of use, and/or enjoyment by the owner, has legal effect from its declaration (ex nunc) instead of retroactively (ex tunc) ".

Nice combo! but are they the same?
The STJ noted however that the case was based on the absence of confusion between the marks - and not in the revocation of the earlier mark. The Federal Regional Court of the 4th Region recognized the right of Calçados Only and acknowledged that the company had from the beginning the right to obtain the registration of its trade mark. Accordingly, the expressions Lyon and Lyon Dor (part of the name Piernas Lyon Dor) evoked different things; besides, the trade marks identified products aimed at different markets: shoes in first case and socks in the second [OK, they are not equal; but are they similar? I am afraid for a trade mark case, they are not similar because they are not really competing products. Moreover, we could see perhaps association in here, but this is not enough since there is the need of actual confusion].

Evergreening y el concepto de litigios estratégicos en Argentina: caso Eli Lilly con Ivax

En Argentina, en la causa n° 12453/2002 caratulada "Eli Lilly and Company y otro con IVAX/Argentina S.A.S/cese de uso de patentes", la Sala Civil y Comercial Federal II de la Cámara nacional de Apelaciones dictó sentencia el 29 de noviembre de 2012 por la que rechazó la demanda iniciada por Eli Lilly contra Laboratorios Armstrong S.A.C.I.F., hoy IVAX Argentina S.A.

En apretada síntesis, y según informa el interesante comentario intitulado "Argentina: Eli Lilly pierde juicio con IVAX. Olanzapina, evergreening y litigios estratégicos" contenido en el "Boletín de Noticias sobre Propiedad Intelectual Año 2 Nº 1" (en adelante, "el Comentario"), la Cámara de Apelaciones sostuvo que "el mero hecho de que los productos de Ivax hayan contenido Olanzapina no resulta en principio un elemento de convicción determinante a los efectos de dilucidar si se trata de Olanzapina u de Olanzapina forma II polimorfa, que es la protegida por la patente 2719 de Eli Lilly. Por ello se destacó que, encontrándose a cargo de Eli Lilly la carga de la prueba, éste 'no ha aportado elementos de juicio' que convenzan respecto de la existencia de infracción a sus patentes. En palabras de la Cámara 'las actitudes de los accionantes llaman la atención y no benefician –como es obvio- su posición'. Consecuentemente, al no haber acreditado Eli Lilly los hechos invocados en su demanda, la Cámara decidió que correspondía rechazar su demanda".

La historia de este litigio, que ha durado diez años, se relaciona con la Olanzapina, el "evergreening" y los litigios llamados "estratégicos", que son analizados con detalle en el Comentario, algunas de cuyas apreciaciones resumimos a continuación.

La Olanzapina es un medicamento antipsicótico, utilizado principalmente   para tratar la esquizofrenia y trastornos de ansiedad, que en 1993 fue registrado en Estados Unidos a favor de Eli Lilly concediéndose la patente US 5,229,382. Sin embargo, según informa el Comentario, la Olanzapina habría sido anticipada dentro de la estructura tipo Markush contenida en la patente GB 1,533,235, concedida en Gran Bretaña en 1978 respecto de la Flumezapina. Así planteado (como lo hace el Comentario), se trataría de un caso típico de "evergreening" y de "litigio estratégico". 

Como informa el Comentario, el término "evergreening" está referido -en este contexto- a la práctica (abusiva) desplegada principalmente por ciertos laboratorios internacionales que intentan extender el tiempo de protección de las patentes más allá del plazo legalmente previsto, mediante sucesivas presentaciones de solicitudes de patentes de bajo nivel inventivo, con el fin de pretender prolongar el monopolio sobre determinadas invenciones. A su vez, "los litigios estratégicos" -en el sentido estipulado en el Comentario- son un tipo de práctica abusiva vinculada con las patentes de invención que se configura mediante la presentación de demandas judiciales inconducentes, que obligan a los competidores de los titulares de patentes a incurrir en cuantiosos gastos.

El Comentario sostiene que en Argentina las invenciones cubiertas por las patentes extranjeras recién citadas de Olanzapina, formaron y forman parte del dominio público, por cuanto fueron divulgadas con anterioridad a la entrada en vigencia de la actual ley 24.481 [de Patentes de Invención y Modelos de Utilidad de 20/03/1996], dictada como consecuencia del ingreso de la Argentina a la Organización Mundial de Comercio, que obligó al país austral a otorgar patentes sobre productos medicinales.

En ese contexto normativo la empresa Eli Lilly obtuvo en Argentina la patente 253.521 concedida en 1999 y con vencimiento en 2014 [solicitud de 24.04.91 prioridad CUP 25.04.90], que sólo cubre un procedimiento para obtener la Olanzapina, en base a la prioridad de la patente US 5,229,382. Adicionalmente, Eli Lilly también obtuvo en la Argentina –entre otras- la patente nº AR002719B1, concedida en 2001 y con vencimiento en 2016, que cubre la forma polimórfica II de Olanzapina. El Comentario sostiene (en apoyo de su tesis) que esta nueva patente podría constituir un eslabón de una estrategia de "evergreening".

Con sustento en la patente AR002719B1, en los años 2001 y 2002 se concedieron medidas cautelares a favor de Eli Lilly que ordenaron a un grupo de laboratorios -entre ellos a Laboratorios Armstrong SACIF, hoy IVAX Argentina S.A.-, a cesar en todo acto de comercialización de productos medicinales que contuvieran como principio activo la forma II polimórfica de Olanzapina. Dichas medidas cautelares fueron dictadas cuándo aún no había entrado en vigencia la ley 25.589, modificatoria de la Ley de Patentes, dictada como consecuencia de la Solución Mutuamente Acordada alcanzada entre la Argentina y EEUU en el marco de la OMC, que permitió balancear adecuadamente los derechos de las partes en los conflictos sobre patentes de invención, evitando el dictado de medidas cautelares inaudita parte y sin sustento científico suficiente. 

En definitiva, la demanda iniciada por Eli Lilly contra Laboratorios Armstrong S.A.C.I.F., hoy IVAX Argentina S.A. fue rechazada en sede apelación, con condena en costas.

El Comentario concluye haciendo notar que, no obstante la derrota en instancia y condena en costas, como consecuencia de la estrategia judicial de la demandante se redujo la oferta de Olanzapina en el mercado argentino, permitiendo a Eli Lilly "incrementar el precio de su producto marca Zyprexa un promedio de 244% para sus distintas presentaciones desde el precio vigente en julio 2001 hasta la fecha en que comenzaron a ingresar nuevos competidores que lograron sortear su maraña de patentes (años 2008/9)". Visto así, se trató (por un lado) de una victoria pírrica y (por otro) de un acertada prognosis del coste-beneficio de utilizar como táctica el mecanismo del litigio en la sede escogida.

Chile en vías de aprobar Protocolo de enmienda al ADPIC o TRIPS

En Chile Senadores de la Comisión de Relaciones Exteriores aprobaron la iniciativa legislativa que, entre otras materias, promueve la innovación tecnológica, la transferencia y difusión de tecnología en beneficio recíproco de productores y usuarios de conocimientos tecnológicos. 

Así, quedó en condiciones de ser analizado por la Sala del Senado el proyecto de acuerdo, en segundo trámite, que aprueba el "Protocolo por el que se enmienda el Acuerdo sobre los Aspectos de los Derechos de Propiedad Intelectual Relacionados con el Comercio".

Este paso tuvo lugar luego de que la Comisión de Relaciones Exteriores, aprobara la iniciativa que permite flexibilizar la obligación de pagar patentes cuando el producto involucrado sean medicamentos. Así lo afirmó el senador Juan Pablo Letelier, presidente de la instancia, quien recordó que "el acuerdo internacional [ADPIC] reflejó una serie de dificultades para los países cuyas capacidades de fabricación de medicamentos son insuficientes o inexistentes para hacer uso de las licencias obligatorias”. Agregó que “esta es una modificación a los compromisos internacionales de Chile respecto a las patentes industriales con fines comerciales. El protocolo permite flexibilizar un punto que fue polémico en años 90 cuando los países desarrollados pretendieron imponer este criterio incluso cuando estos productos eran medicamentos”.

Además puntualizó que “este protocolo flexibiliza el acuerdo para que en los países se puedan producir o importar medicamentos genéricos sin tener que pagar patentes o royalties cuando exista de por medio un interés nacional”.

Recordó que con ocasión de una emergencia de salud pública que vivió el país el año pasado se quiso importar medicamentos para abordar un proceso de vacunación especial en el país. “Con este protocolo se va a permitir al país importar medicamentos no de los laboratorios que cobran carísimo sino que en caso de existir un interés nacional se pueda recurrir a otros productos para enfrentar los problemas de salud pública”.

Por su parte, el senador Carlos Kuschel, integrante de la instancia, también destacó la aprobación de esta iniciativa que apunta a reducir las distorsiones del comercio internacional y los obstáculos al mismo resultantes de una inadecuada protección de los derechos de propiedad intelectual entre los países.

Brazil: Marca Lusófona

Last week the Representatives of the Community of Portuguese Language Countries (CPLP) met to discuss the creation of the mark ‘Lusófona’. This is a proposed system that aims to simplify and modernize the registration of trade marks in Portuguese speaking countries.

In attendance were all 8 representatives of national institutions in charge of the trade mark registrations i.e. Angola, Brazil, Cape Verde, Guinea-Bissau, Mozambique, Portugal, Sao Tome and Principe ,and East Timor. The plan is to “intensify trade relations, promote modernization and strengthen the exchange of experiences and information between citizens, institutions and companies operating in the Portuguese-speaking countries.” The representatives signed a declaration reaffirming their commitment to the implementation of  Lusófona.


I wonder whether the mark ‘Lusófona’ is to be registered, and if so, will it have opposition from the group Lusófona? This international group administers universities and colleges in some of the Portuguese speaking areas. Moreover, looking at the dictionary we understand that the word means "of the Portuguese language" or "Portuguese-speaking”; thus, it will lack of distinctiveness. But I guess I am outside the box and we should concentrate on the system as such and the aim of it – for now.

Colombia pone hoy en marcha Oficina Virtual de Propiedad Industrial

Hoy es el lanzamiento desde las instalaciones de la Cámara de Comercio de Medellín, de la Oficina Virtual de Propiedad Industrial de la SIC colombiana.

Para el evento se cuenta con la presencia del Superintendente de Industria y Comercio, Pablo Felipe Robledo Del Castillo, acompañado por el Superintendente Delegado para la Propiedad Industrial, José Luis Londoño Fernández y la presidenta de la cámara de esta ciudad, Lina María Vélez de Nicholls, presentarán a todo el país la 

Esta Oficina Virtual de Propiedad Industrial permite a los usuarios presentar y adelantar los trámites de solicitud de marcas, lemas comerciales, nombres y enseñas comerciales, patentes, diseños industriales y esquemas de trazados de circuitos integrados, así como también antecedentes marcarios, respuestas, recursos, consultas y notificaciones, entre otros servicios, con sólo entrar a la página: www.sic.gov.co

Con este nuevo sistema, "[l]os ciudadanos no tendrán la necesidad de venir a la capital del país, pues podrán presentar sus solicitudes de propiedad industrial de manera directa: Estamos 'desbogotanizando' la superintendencia" afirmó Robledo en el sitio web de la SIC.

De acuerdo con el superintendente, las ventajas de la Oficina Virtual se reflejan, además de la obtención del 5% de descuento sobre las tarifas establecidas por pago en línea, en "[l]a inmediatez y la seguridad de que todas las solicitudes serán tramitadas como si se hubieran realizado de manera presencial".

Para acceder al nuevo servicio de trámites en línea, el usuario deberá registrar su identificación de usuario y contraseña, con las cuales podrá hacer uso del sistema y presentar todas las solicitudes relacionadas con Propiedad Industrial que desee. Igualmente, encontrará las guías de trámites de solicitud de marcas y de patentes en Colombia, las cuales lo orientarán en las diferentes etapas por las que debe pasar una solicitud, así como los elementos básicos que debe tener en cuenta en cada una de ellas.

Colombia: disposable underwear is not inventive

Last week, we read in the Colombian newspaper Portafolio that the Council of State (highest court of administrative litigation and the government’s advisory body) ended a dispute between an entrepreneur and the Superintendence of Industry and Commerce (SIC).

The State Council denied the request to grant a patent for disposable underwear. According to the lawsuit SIC had denied the patent because it lacked of inventiveness. The claimant on the other hand, claimed that SIC had failed to properly interpret the subject matter of the invention and its technical advantages. Also, it emphasised that this patent was already registered and accepted in other countries.
Is it obvious why super-heroes wear their underwear over their tights?
The key question confronted by the Council State was if the disposable underwear preventing leakage represented a qualitative change in the state of the art. The State Council agreed with SIC and denied the registration of the said product. It explained that the product did not fulfil one of the requirements (novelty, inventive step and industrial application) for granting a patent i.e. inventiveness. It went on to say that there was not inventiveness since the product represented a solution which was already found in other goods e.g. diapers. Finally it said that the inventive step is not tested by the fact that the product enjoyed patent protection in other countries.

The inventive step is tested towards what is obvious to someone with a good knowledge of the subject (an expert) and having regard to what forms part of the state of the art. There is the need to identify what differences exist between the matter cited as forming part of the ‘state of the art’ and the inventive concept of the claim. Obvious does NOT gain protection BUT only what is inventive.

Colombia, Medellin: the most innovative city

The city of Medellin, Colombia, has been voted the ‘most innovative city’ which take place in the ‘city of the year’ contest. The panel jury included Citi Group executives, the Wall Street Journal (WSJ) and the international centre Urban Land Institute (ULI). The matters assessed and which played a major role in the decision were: mass transport system, reduction of CO2 emissions, cultural spaces and work of municipal utilities companies. Regarding these, it has to be said that the public transportation is used by more than 500,000 people each day; there is also a public bike-share program; a new library and a cultural centre; a large outdoor escalator which allows to ride down a steep hillside, the size of a 28-story building; among others.

Medellin won against the other two contestants i.e. New York and Tel Aviv. The news were received and celebrated in the auditorium Guillermo Cano, the Alpujarra Administrative Centre, in Medellin, when Mayor Aníbal Gaviria confirmed the news. He explained that the city won because ‘it has to show the world innovations. Even over cities with larger budget.’

In April, The Journal Wall Street will be publishing a special segment on the city where apart from covering its history and some of the city’s images, it will also discuss its progress and potential. This is good news for Medellin, but also for Colombia. This may attract more (foreign) investments in the form of trade and/or R&D. There is no doubt that innovation goes hand in hand with IP and with the signing and ratification of mayor IP agreements that have recently happen in this country, we will be watching Colombia very closely to see how this country flourishes.
